Just so as we are clear on the claims versus/acussationary part of 
Bernhards post of today... I submit the following from 2004.

Opening line is the point.  The rest is taken for granted.  Of course 
patents are to be respected to the degree they are valid, and of course 
due respect to all who contribute each in their own way to the common 
knowledge pool.

For what its worth... there is a pretty good exchange of posts on 
exactly all this subject matter between Bernhard, myself, and several 
others... for anyone who is interested purely in the subject matter itself.
